By accessing our site and/or purchasing from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including additional terms, conditions, and policies referenced herein. These Terms apply to all users of the site including browsers, customers, vendors, merchants, and content contributors.

Our store is hosted by Shopify Inc., which provides the e-commerce platform enabling us to sell our products and services.
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms, you confirm you are at least the age of majority in your jurisdiction or have provided consent for any minor dependents to use this site.
You may not use our products for illegal or unauthorized purposes. A breach of Terms will result in termination of service.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
Your content (excluding credit card info) may be transferred unencrypted and involve:
(a) transmissions over various networks, and
(b) changes to conform and adapt to technical requirements of connecting devices.
Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy or exploit any part of the service or website content without written permission.
SECTION 3 – ACCURACY OF INFORMATION
While we strive to keep information current, we are not responsible if any content on this site is not accurate, complete, or current. Historical information is provided for reference only.
We reserve the right to modify site content at any time without obligation to update any information.
SECTION 4 – MODIFICATIONS TO SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right to modify or discontinue any service or product at any time without notice.
SECTION 5 – PRODUCTS OR SERVICES
Some products may be offered exclusively online and in limited quantities. Return and refund eligibility is governed by our official Refund Policy.
We strive for accurate product images and descriptions but cannot guarantee colour display accuracy on all screens.
We reserve the right to limit sales geographically or per customer, and may discontinue any product without notice.
SECTION 6 – BILLING & ACCOUNT INFORMATION
We reserve the right to limit or cancel any order.
You agree to provide current and accurate purchase and account information.
If a payment is delayed, we may charge interest (7% annually, accrued daily) and may treat continued failure to pay as a termination of service. Payment must be made via bank transfer unless otherwise agreed.
All Small-Scale Technology Certificates (STCs) related to your solar system must be transferred to Huracan Energy post-installation.
SECTION 7 – INSTALLATION & ACCEPTANCE
You must ensure the site is clear and accessible. If it’s not, we may reschedule or charge up to $1,000 to cover our contractor’s lost time.
Post-installation, we test the system. If it doesn’t meet the specifications, we have 20 days to fix it. If we can’t, you may receive a full refund.
SECTION 8 – WARRANTY
We warrant our equipment to be free of defects in materials and workmanship. Any defective parts during the warranty period will be repaired or replaced.
Improper use voids the warranty. If we cannot fulfil the warranty, the manufacturer will.
SECTION 9 – TRAINING & SUPPORT
We provide training at installation and remote support for software setup and system optimisation.
You will receive all relevant safety, maintenance, and operational manuals.
SECTION 10 – ERRORS & INACCURACIES
We reserve the right to correct any errors or omissions and to update information at any time without notice.
SECTION 11 – PROHIBITED USES
You may not use the site or its content for:
- Any unlawful purpose
- Soliciting others to perform unlawful acts
- Violating any international, federal, or local regulations
- Infringing intellectual property rights
- Harassment or discrimination
- Uploading malicious code
- Collecting personal data
- Spamming, phishing or scraping
We may terminate access for violating these rules.
SECTION 12 – DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
We do not guarantee uninterrupted, secure or error-free service. Your use is at your own risk.
Huracan Energy shall not be liable for any direct, indirect, incidental or consequential damages.
SECTION 13 – INDEMNIFICATION
You agree to indemnify and hold Huracan Energy harmless from any claim arising from your breach of these Terms.
SECTION 14 – SEVERABILITY
If any provision is found unenforceable, the rest of the Terms remain in full effect.
SECTION 15 – TERMINATION
Either party may terminate these Terms. You may stop using the service at any time. We may terminate if you violate any Terms.
SECTION 16 – ENTIRE AGREEMENT
These Terms and any policies referenced constitute the entire agreement between you and us.
SECTION 17 – GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia.
SECTION 18 – CHANGES TO TERMS
We may modify these Terms at any time. It is your responsibility to check for updates.
